Gem County Development Services, Building Department
Gem County Development Services enforces the county's building regulations and issues residential building permits for unincorporated land, and its Building Official has 30 days to review plans. A barndominium lived in as a home needs a standard building permit. The City of Emmett runs its own Building Department inside its limits.

- Gem County issues an agricultural zoning permit in place of a building permit only for a structure on a parcel of at least 5 acres in an agricultural zone used strictly for agricultural purposes such as livestock or hay storage; buildings with facilities or offices do not qualify, so a barndominium needs a standard building permit (read 27 Sep 2026).
- Flood zones along the Payette River
- The county enforces its own Flood Control ordinance (Title 13) and checks FEMA maps for a parcel on request. A building permit is still possible inside a flood zone if Title 13 is met, but an Elevation Certificate is required and fill in the floodplain needs engineering studies (read 27 Sep 2026).
- Septic approval before the building permit
- Gem County's Building FAQs state that since 3 July 2023 a permit from Southwest District Health approving the site plan is required for all building permits, and that adding bedrooms to a house needs the district's paperwork first (read 27 Sep 2026).
