The building permit, the zoning and the septic permit can come from three different offices. Here is who decides each part in Cassia County, taken from the office or document that publishes it. Rules change, so check them again against your parcel before anything is drawn.
Cassia County Zoning and Building Department
On unincorporated land the county requires a building permit to construct, relocate or remodel a building under the code it has adopted, and its inspectors check setbacks, footings, foundation, framing, energy and final. Starting without a permit doubles the fee. Electrical, plumbing and HVAC work is permitted separately through the state program. Most cities, Burley among them, run their own building departments inside their limits.

- The county's permit page states that the minimum lot area for any dwelling unit in the unincorporated county is one acre (with exceptions in 9-4-2), and that front and street-side setbacks run 54 feet from the centre of the adjoining street, with 15-foot rear and side yards outside the industrial commercial zone (read 27 Sep 2026).
- Right-to-farm waiver in the prime farm zone
- In the prime agricultural (AP) zone, anyone seeking a permit to build a residence must first sign and file with the county building inspector an acknowledgment and waiver recognising dust, noise, odours and spraying from normal farm and livestock operations (Cassia County Code 9-7-3, read 27 Sep 2026).
- Farm building permits are not for homes
- Cassia County issues an Agricultural Siting Permit for structures that house implements, hay, grain, poultry or livestock, but states that agricultural buildings shall not be places of human habitation; any other use needs a building permit, so a barndominium goes through the building permit route (read 27 Sep 2026).

Rural parcels here need to clear the one-acre minimum for a home, then the zone: the prime farm zone protects irrigated ground and asks for a right-to-farm waiver, while the agricultural residential and residential agricultural zones are aimed at homes among farms.
